Du « sujet » au « citoyen italien de race juive ». La circulation des catégories raciales dans le droit fasciste

Abstract : The Declaration on Race, a text approved by the Great Council of Fascism in October 1938, defines the “Jewish problem” as “the metropolitan aspect of a problem with a general character”. Colonial and anti-Jewish racial policies lie on the same continuum. Showing the complementarity between metropolitan and ultramarine spaces in the sources of the fascist period should retain the attention of the legal historian concerned with the study of institutionalized racism. Indeed, when the government adopts the first measures affecting “persons belonging to the Jewish race”, the Italian legal arsenal on racial matters is already well equipped. Categories, legislative techniques and uses of the concept of “race” have already been forged under colonial law since the end of the 19th century. This article retraces the colonial path of establishing racial categories. To this end, it focuses on the crucial moments in the fundamental link between the metropolis and the overseas territories: the strengthening of the ius sanguinis principle within the framework of colonial legal pluralism; the gradual adoption by specialists in public and colonial law of a language more influenced by the notion of “race”; the establishment, by doctrinal and jurisprudential means, of the impediment to mixed marriages; the definition of the legal status of Italian-African mixed race people.
