La réglementation internationale du commerce international des armes classiques : le Traité du 2 avril 2013 et la protection de la personne

Abstract : The adoption of the Arms Trade Treaty by the United Nations General Assembly is a milestone in the international regulation of conventional arms trade. In the context of conventional arms trade, the Treaty marks a significant progress in the prevention of international crimes, human rights and international humanitarian law violations. It establishes a balance between States’ interests in the area of conventional arms trade and the protection of human rights. However, the balance is fragile and the protection of human rights insufficient. The scope of the Treaty is somewhat restrained and there is no international and independent organ in charge to control the respect of its provisions.
